Pay it Forward Rising Leaders 2016  

Official Rules for Public Voting

1. Rising Leader Eligibility:  Four Rising Leaders groups/individuals (the “Rising Leaders”) have previously been selected from a list of nominations provided by community leaders, the public and not-for-profit organizations.   Rising Leaders must be legal residents of the State of Alabama or Tennessee (as applicable) and live within the Huntsville Designated Market Area (“DMA”) as defined by The Nielsen Company. This includes Colbert, DeKalb, Franklin, Jackson, Lauderdale, Lawrence, Limestone, Madison, Marshall and Morgan counties in Alabama and Lincoln County, Tennessee.  Void where prohibited and outside the DMA.  Employees of WHNT-TV, WHNT License, LLC, Mungo Homes, 415 Church Street, Building E, Suite 2, Huntsville, AL 35801 (collectively, the “Sponsors”), and of each of their respective affiliates, parents and subsidiaries, promotional agencies and their advertising agencies, employees of other television or radio stations, and members of the immediate families of such employees are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents and grandchildren, and any other person residing at the same household whether or not related. Winning a prize is contingent upon fulfilling all requirements set forth herein.

2.  Voting Period: Voting on Rising Leaders begins Monday, May 30, 2016, at 7:00 PM CT and ends Friday, June 3, 2016 at 11:59 PM CT (the “Voting Period”).

3.  To Cast a Vote: To vote for your favorite Rising Leader(s), go to http://whnt.com/2016/05/19/vote-in-our-pay-it-forward-rising-leaders-contest/ and read all four Rising Leader(s) profiles and click the vote button for your favorite Rising Leader(s).  

4. Conditions Applicable to Public Voting: Each voter is limited to one vote per day and one vote per email address per day. Voters must be 14 years old or older and must be physically located in the United States when they cast their vote. The use of automated devices for voting is not permitted and will result in the disqualification of all votes received through that method and/or from that voter. Any use of robotic, repetitive, automatic, programmed, script, macro, or any other automated means or similar participation methods or agents, vote exchange websites, vote “farming” or other method to vote or unfairly increase votes, as determined by Sponsors in their sole discretion, is prohibited and will void all votes submitted by that voter. Moreover, if Sponsors conclude, in their sole discretion, that any Rising Leader(s) has colluded with a voter in the activities set forth above or has participated in or actively encouraged such activity, whether directly or indirectly, Sponsors may disqualify that Rising Leader(s) from further participation in the Pay it Forward Rising Leaders 2016 Contest (the “Contest”) and or eligibility for any prize.

4.  Winner Selection:  The Rising Leader(s) with the most validated votes received during the Voting Period will be declared the winner. If there is a tie for first, voting will continue for consecutive one-hour periods until the tie is broken. The winner will be announced on or about Monday, June 6, 2016 during WHNT News 19 at 6:30 and posted on WHNT.com. All results are unofficial until winner is verified. Sponsors will attempt to contact a member of the winning Rising Leader(s) by email. All members of the winning Rising Leader(s) group (and the parent or legal guardian of any member who is a minor in his or her state of residence) will be required to sign an Affidavit of Eligibility/Release of Liability and Publicity (TN residents need not sign Publicity release) and to return such documents to Sponsors within five business days of the date Sponsors send them to winner. If (a) any member of the winning Rising Leader(s) group does not meet all of the eligibility requirements; (b) the winner is not in compliance with the Official Rules; or (c) the winner does not respond to the notification email within 24 hours, Sponsors may disqualify the winner and designate another winner by applying the criteria set forth above.

5. Prize:  The winning Rising Leader(s) wins a $1,000 Pay It Forward grant for their community efforts. The other three finalists will each receive a $100 Pay It Forward grant for their community. Grants will be awarded in the form of cash payable to each Rising Leader.

6.  Conditions:  Sponsors reserve the right, in its sole discretion, to cancel, terminate, modify or suspend this Contest or any portion hereof, or to disqualify any individual implicated in any of the following actions, if for any reason:  (a) infection by computer virus, bugs, tampering, unauthorized intervention, actions by voters, fraud, technical failures, or any other causes which, in Sponsors’ sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, (b) the Contest or any website or application associated therewith (or any portion thereof) becomes corrupted or does not allow the proper processing of votes per these Rules, (c) the Contest becomes corrupted due to interruption in wireless calling devices or wireless service for any reason, or (d) the Contest is otherwise not capable of running as planned.   If Sponsors determine, in their sole discretion, that technical difficulties or unforeseen events compromise the integrity or viability of the Contest, Sponsors reserve the right to void the votes at issue, and/or terminate the relevant portion of the Contest, including the entire Contest, and/or modify the Contest. If Sponsors terminate the Contest, they will determine the winners based on all eligible, non-suspect votes received as of the termination time. If Sponsors terminate or modify the Contest, Sponsors will post notice on the WHNT website, whnt.com.  By voting, voters represent that they are eligible and agree to be bound by and comply with the Rules and the decisions of any judges, which are final on all matters pertaining to the Contest.  Any voter or Rising Leader(s) who attempts to tamper with this Contest in any way or use fraudulent means to participate in the Contest will be disqualified.  Sponsors reserve the right to disqualify any voter and/or Rising Leader(s) at any time, for any reason, including, without limitation, language, activities or behavior deemed inappropriate. Sponsors have the sole discretion to administer the Contest and interpret and apply the Rules. 

7.  Limitation of Liability:  Sponsors and each of their respective affiliates, parents, subsidiaries, advertising and promotion agencies, officers, directors, employees, representatives, and agents (the “Released Parties”) are not responsible or liable for: (a) any errors in the printing, offering or administration of the Contest or in the announcement of the prize(s), (b) any error, omission, interruption, defect or delay in operation or transmission at any website, or wireless calling service, interrupted or unavailable network, server or other conditions, (c) failure of any vote to be received by Sponsors due to technical problems, telephone service problems, human error, or wireless calling service, (d) communication line, hardware and/or software failures, malfunction of phones (including wireless phones/handsets), phone lines, other communications malfunctions, unavailable network connections, cellular equipment towers, telephone systems or wireless service, (e) damage to any computer (software or hardware) resulting from participation in the Contest, or damage to mobile phone or other PDA device, (f) theft or destruction of, tampering with, unauthorized access to, or alteration of votes, (g) votes that are late, lost, stolen, damaged, illegible, and/or unintelligible (or any combination thereof), (h) any change of email address, mailing address, telephone number and/or any other contact information provided by voter, or (i) mechanical, technical, computer, hardware or software errors, malfunctions, or failures of any kind, including but not limited to failed, incomplete, garbled, or delayed transmission of votes, traffic congestion, viruses, sabotage, satellite failures, electrical outages, on telephone lines, on the Internet, at any website, or application or lost or unavailable network connections or natural disasters or acts of God or man, that may limit a voter’s ability to participate in the Contest. 

Neither the failure of Sponsors to insist upon or enforce strict performance of any provision of these Official Rules nor the failure, delay or omission by Sponsors in exercising any right with respect to any term of these Official Rules, will be construed as a waiver or relinquishment to any extent of Sponsors’ right to assert or rely upon any such provision or right in that or any other instance.

8.  Choice of Law/Forum:  Alabama law will govern this Contest, without regard Alabama’s choice of law rules.  The courts of Alabama will be the exclusive forum for any dispute regarding any Rule or activity associated with the Contest.

9.  Official Rules:  To request a copy of the Rules, send a self-addressed, stamped envelope to WHNT-TV, located at 200 Holmes Avenue, Huntsville, AL 35801 by June 6, 2016.  Written copies of these Rules are also available during normal business hours 8:00AM – 5:00PM CST at WHNT-TV’s business offices or online at WHNT.com. 

10.  Names of Winners:  For the names of the prize winners, send a separate, self-addressed, stamped envelope to WHNT-TV, located at 200 Holmes Avenue, Huntsville, AL 35801 or appear in person at that location between normal business hours 8:00 AM – 5:00 PM CT after June 6, 2016. Requests must be received by June 30, 2016.

11.  Rights Reserved:  The content, information, data, designs and code associated with the Contest and Contest website are protected by intellectual property and other laws. Any unauthorized use of copyrighted materials, trademarks, or any other intellectual property of Sponsor without the express written consent of its owner is strictly prohibited.
